1. Terms and Conditions

The following terms and conditions apply from the time of order validation. They apply to orders from the “Kunst- und Waffenkammer Ute Nitsche” catalogue or from the online store between Ute Nitsche, the seller, and you. Any changes or deviations from these conditions are only binding if they are recognised in writing by Ute Nitsche.

2. Orders and Signing of the Contract

Upon our receipt of your order you will receive an order conformation by email in which the details of your order are listed. This order confirmation does not represent a sale, but serves as verification by the seller. A sales contract can only come to be, through the sending of the order confirmation. In the case, that a particular item cannot be delivered, we commit ourselves to informing the buyer before the acceptance of the order. The seller reserves the right to rescind the contract, due to any circumstances or higher authorities for which the seller cannot be held responsible. In this case the buyer would be immediately informed, and payments immediately refunded.

The information found in price lists, catalogues, advertisements, and on internet sites is always subject to confirmation and is non-committal. This particularly applies to information about the product, which should be used only as guidance (such as quality, condition, dimensions etc.). “Kunst- und Waffenkammer Ute Nitsche” is in no way responsible for any incorrect or misrepresented information.

3. Special precautions in place for the purchase of weapons

The purchasing of: airguns and spring-loaded weapons with a kinetic energy of under 7,5 Joules, crossbows, blank weapons, weapons for salutes, weapons with fuses or remote controlled ignition, single barreled percussion guns and pin ignited weapons which are of models developed before 01.01.1871: is only available to people over the age of 18. In order to acquire the other types of firearms that are not named above, a valid purchase permit or shooting license is required. The order will start to be processed only after receipt of these required documents (ID) and permit. For this we allow a period of 14 days from the time of ordering, after this time period the order will be cancelled.

4. Prices and Payment conditions

The listed prices are the final prices for the items in Euros, and include the VAT incurred. A further financial statement of the VAT is not necessary because the items are second hand goods, and are liable to §25a VAT gap tax. Shipping costs are disclosed separately.

In cases where the buyer is unknown, then prepayment is required to be made before the delivery. The amount invoiced is due upon receipt of the order confirmation. There are no cash discounts allowed. If within 14 days of sending the order confirmation no money has been received, then “Kunst- und Waffenkammer Ute Nitsche” is entitled to cancel the order.

5. Delivery and Shipping

According to the Arms Act we can only supply all sorts of weapons to people over the age of 18. A copy of an identity card needs to be sent as proof of age.

The delivery will only be made once the total amount that is due is received without any deductions. With regards to transfers, this is the day that the account of the seller is credited with the money. Unless otherwise agreed, the delivery will be made to the address mentioned on the order confirmation. If there is a delay in the receipt of delivery, then the buyer bears all further costs. “Kunst- und Waffenkammer Ute Nitsche“is authorised to make partial deliveries.

6. Warranty.

You have one week commencing immediately upon receipt of delivery to check the contents and to make sure there are no faults. In the case that there are defects, please send immediately a defect notification. The warranty is not applicable for defects that have been caused by improper use, normal wear and tear, improper handling, and bad storage of the goods on your part. There is no liability for any damages or defects that are not on the product itself, especially not for financial losses. The above mentioned limitation of liability does not apply if the damage is caused by intent or gross negligence, or if personal injury is involved. Should one of the main contract obligations be violated, then the compensation obligations for item damage from “Kunst- und Waffenkammer Ute Nitsche“is limited to the foreseeable damage, which does no exceed the purchase price of the ordered goods.

The description of the state of preservation is subjective, but created using the best of our available knowledge and beliefs. This represents no guaranteed quality. The colours and illustrations of the depicted products may, for various reasons, be slightly different to the original.

7. Right of withdrawal

As the consumer, you can return the contract within 30 days in written form (such as letter, fax and e-mail) without providing reasons, or by returning the goods. The period begins upon receipt of this cancellation. To ensure the cancellation period is enough requires the timely dispatch of the cancellation or the goods.

The right of withdrawal does not apply in exceptional cases regulated by law, especially not on delivery of the goods, according to customer specifications and changes, or those which are clearly fitted to personal needs.

Cancellation policy

In cases where a successful cancellation has taken place, both sides must give back any received payments, and where appropriate, any other items or benefits. If you cannot return the entirety of the items, or if only partly, or in a worse condition than they were received, then you are liable to pay compensation to the value of the piece(s). It is possible to avoid these compensational obligations, by refraining from use of the product in your possession, whereby the worth could be affected. Mail-able items should be posted back. If the cost for returning the goods does not exceed 40 euros then you must cover it yourself, when the delivered item corresponds to the order. This is contractually agreed. In all other cases the returning of goods is free for you. You must pick up items that cannot be sent yourself. You are obliged to reimburse any payments within 30 days from the sending of your cancellation. Payments must be made within 30 days after the sending of your declaration of intent.

8. Complaints / Returns

Please check the delivery immediately for damage to the packaging. Should this be the case, then get the transport company to confirm this or deny it in writing. Next inform us about any possible damage on the item itself by a written notification.

9. Privacy Policy

Customers’ personal data is used by us for a specific purpose, ie. for the completion of the contract, and is processed in accordance to the statutory terms. The data will be treated confidentially and not passed on to unauthorised third parties.

10. Jurisdiction

Our jurisdiction and place of work is Heilbronn

11. Final Clause

Should one or more clauses of these terms and conditions be invalid, or oppose legislation, then the validity of the remaining clauses is unaffected.
